
Terms & Conditions
1. GENERAL TERMS
These terms govern all tuition and coaching services provided by CJH English Language Tuition (CJH). All communications, including joining instructions, will normally be sent to students by email.

The decision by an Applicant to submit an Application Form shall represent an acceptance of these terms and conditions.
​
No variation or alteration of these terms and conditions shall be valid unless approved in writing by CJH.
2. DEFINITIONS
The following phrases shall have the following meanings in these Terms:
Course Start Date: the date of the first session, or the date of receipt of materials, if any, for the first session, whichever comes first.

Applicant: the person completing Application Form for group, or individual tuition from CJH.

3. BOOKINGS
Once a booking is confirmed in writing (including email, letter & online confirmations) an agreement will be formed between us. The fee (together with VAT if appropriate) will then be invoiced with payment terms below.

4. PAYMENT TERMS

Individual online and telephone bookings: Payment is due on confirmation of booking and should be received by CJH at least 10 business days prior to the Course Start Date. If the booking is confirmed within 10 business days of the Course Start Date, then payment is due immediately.

Company Bookings: Invoices will be issued in advance of the Course Start Date and payment is due within 10 business days of the invoice date or before the course start date, if sooner. Payment must be made before the start of any course.

Payment Method: Payments of the full invoice amount should be made by direct transfer to CJH bank account using the details on the invoice. Payments should be referenced with the invoice number.

Late Payment: We reserve the right to withdraw any discount offered and/or to levy a late payment charge of 100 Euros plus vat, if appropriate if payment is received outside these terms.

5. PREPARATION FOR THE COURSE

You agree you/your students will have submitted Needs Analyses and have the starting level of competences as assessed in Application Test(s) made before booking confirmations as provided by a CJH tutor.

You/ your students will have sufficient time to attend lessons at time(s) specified.

You are responsible for ensuring that you/your students have adequate internet connection to fully access video conferencing.

You are responsible for ensuring that you/ your students can access tuition using a PC, laptop or other device on which you/ your students can see and read written information displayed or shared on communications platforms (e.g., Zoom, Microsoft Teams, or other)

CJH is not responsible for any additional charges for any additional costs or charges for you/ your students purchasing materials (Dictionaries, Textbooks or other reference materials) from time to time recommended by the tutor as helpful accompaniments to learning.

6. COURSE CHANGES
The start date of the course will normally be as advised at the time of booking confirmation. CJH reserves the right to:

Change the specification and format of its courses without notice;

Change the Tutors to a course without notice;

Change the location (if face-to-face tuition) of the course but will advise the students as soon as practicable; and

Cancel or reschedule any course and will advise the students as soon as practicable. CJH will use all reasonable endeavours to avoid cancellation or rescheduling. When cancellation is unavoidable, CJH will refund, in full, all monies paid, or at your option, apply all monies to a rescheduled or alternative course.

7. CANCELLATION

We reserve the right to charge you a Cancellation Fee in the event that you cancel or postpone the provision of our Services after booking confirmation but prior to the Course Start Date, or during the course of training as set out in this table.
Less than 10 business days’ notice: Cancellation Fee is 100% of Tuition Fee
10-20 business days’ notice: Cancellation Fee is 50% of Tuition Fee
Over 20 days’ notice: No charge

Cancellation must be provided in writing by email and the time is calculated from the time CJH receives the notice. Emails received after 5 pm or on non-working days are deemed received on the next working day. Emails must be sent to chrisjhiggins@cjhtuition.com via the Contact page on this website.

On full course bookings, students may be substituted by other students who have completed and returned Needs Analysis, Applications Test(s) 72 hours prior to the Course Start Date. Students cannot be substituted less than 72 hours prior to the Course Start Date.

In the event that students miss one or more tuition sessions, and request the scheduling of additional sessions, an administration and additional tuition fee will be charged. The provision of additional tuitions following student(s) missing one or more session is at the discretion of CJH. For the avoidance of doubt there are no refunds for students who fail to attend tuition lessons.

CJH reserves the right to exclude a student from tuition, at any stage, in the event that the preparation, behaviour or condition of the student, in the opinion of the tutor, is not appropriate or conducive to the tuition or coaching concerned. The student concerned may appeal the decision through the complaints process.

CJH may sometimes run a competition to win free entry to tuition. In the event that you win free entry to a tuition session or group of sessions that you have already booked, your right to cancel under this clause 5 shall not apply. Any free entries can only be used in addition to any previously booked courses.
8. WARRANTY AND LIABILITY

The maximum aggregate liability will be the charges for the lesson or course out of which the loss or damage has arisen. CJH will not be liable for indirect, special or consequential loss (including loss of anticipated profit or data), howsoever arising, even if it has been advised of such potential loss.

Nothing in these terms and conditions excludes or limits our liability for death or personal injury arising from our negligence, or fraud or fraudulent misrepresentation, or any other liability that cannot be excluded or limited by English Law.

9. COPYRIGHT & CONFIDENTIALITY

You acknowledge that the copyright and all other intellectual property rights in all course materials shall remain the sole and exclusive property of CJH. You undertake that unless permitted by CJH in writing, or the law imposes an obligation of disclosure you will not (i) copy or permit the copying of course materials distributed, whether by photocopying or otherwise, (ii) disclose, permit the disclosure, sell or hire the same to third parties, or (iii) use the same for running courses, except those licensed by CJH.

You agree that neither you nor your students will share any links that are provided for the purposes of the course other than those licensed by CJH.

You acknowledge that (and will inform your students) that audio/video recording of any part of the course is not permitted.

10. REPRESENTATIONS
No statement, description, information, warranty, condition or recommendation contained in any marketing materials, price list, advertisement or communication or made verbally by any CJH tutors shall be construed to enlarge, vary or override in any way any of these terms and conditions.
1`. INDEMNITY & EXCLUSION OF LIABILITY
CJH will not be liable to a student or their Company, except in the case of fraud by CJH, for any act or omission (whether negligent or misleading or otherwise) in the performance or purported performance of CJH obligations under this agreement.
12. FORCE MAJEURE
CJH shall be entitled to delay, cancel delivery or to reduce the training delivered if it is prevented from, hindered in or delayed in the provision of Services through any circumstances beyond its reasonable control including, but not limited to, strikes, lock-outs, accidents, war, governmental actions, national emergency, acts of terrorism, protests, riot, civil commotion, explosion, flood, epidemic, pandemic, fire, reduction in or unavailability of power, internet, illness or break-down of equipment.

14. GOVERNING LAW & JURASDICTION
This agreement is governed by, and is construed and takes effect in accordance with, English law. Unless otherwise specified in any settlement agreement, the courts of England will have exclusive jurisdiction to settle any claim, dispute or matter of difference that may arise out of or in connection with CJH.
